Terms of Service

Welcome to River Caddy! These Terms of Service ("Terms") govern your access to and use of the River Caddy iOS application, website, and related services (collectively, the "Service"), operated by River Caddy LLC ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Use of the Service

You must be at least 13 years old to use River Caddy. You agree to use the Service only for lawful purposes and in accordance with these Terms.

2. Accounts

The iOS app does not require an account and can be used anonymously. If you create an account on our website, you may need to sign in using third-party credentials (e.g. Google). You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Subscriptions and In-App Purchases

River Caddy offers optional paid subscriptions ("River Caddy Premium") that unlock additional features. On the iOS app, subscriptions are auto-renewable in-app purchases sold through the Apple App Store. By purchasing a subscription, you agree to the terms below:

• Billing. Payment is charged to your Apple ID account at purchase confirmation. Prices are shown in the App before purchase and may vary by region.
• Auto-renewal. Your subscription renews automatically at the end of each billing period (monthly or annual, depending on the plan you select) unless you cancel at least 24 hours before the end of the current period. Renewal is charged to your Apple ID within 24 hours prior to the end of the period.
• Managing and cancelling. You can view and cancel your subscription in the Settings app on your iPhone: Settings → your name → Subscriptions → River Caddy. Cancelling stops future renewals; you keep access to Premium features until the end of the current billing period.
• Refunds. All refund requests are handled by Apple, not by River Caddy. Submit refund requests at reportaproblem.apple.com.
• Free trials and promotions. If a free trial is offered, the subscription auto-converts to a paid subscription at the end of the trial unless cancelled beforehand. Any unused portion of a free trial is forfeited if you purchase a subscription before the trial ends.
• Changes to pricing. We may change subscription prices for new billing periods. Existing subscribers will be notified through the App and via Apple before any price change takes effect.

4. User Content

You may submit content such as favourites, spot notes, or feedback. By submitting content to us, you grant River Caddy a non-exclusive, royalty-free, worldwide licence to use, store, display, and distribute your content in connection with operating and improving the Service.

5. License and Intellectual Property

River Caddy grants you a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial use. All content and code within River Caddy — including reports generated by our systems, the spot database, and the design of the App and Site — is the property of River Caddy LLC and protected by applicable intellectual property laws.

6. Prohibited Conduct

• Do not misuse the Service by interfering with its operation or attempting unauthorized access.
• Do not scrape, data mine, or copy fly patterns, river data, reports, or spot data without permission.
• Do not upload or share content that is harmful, unlawful, or infringes on others' rights.
• Do not use the Service to build a competing product.

7. Third-Party Services

River Caddy relies on third-party services (Apple App Store, Supabase, Anthropic, Google, Vercel, USGS, public weather providers) to operate. Their terms and policies apply to your interactions with them. We are not responsible for the content, security, or privacy practices of those third parties.

8. Disclaimers

No Professional Advice

River Caddy provides fly fishing information, suggestions, and data for recreational purposes only. It does not constitute professional guiding, safety instruction, or legal advice. Always use your own judgment and adhere to local regulations and safety precautions when fishing or exploring outdoors.

Not a Guiding Service

River Caddy LLC is not a licensed guide or outfitter and does not provide in-person guiding services. Any recommendations, condition scores, or predictions generated by the Service are informational only and may not reflect real-time conditions.

Regulations

Fishing regulations shown in the Service are informational summaries of publicly available rules. Regulations change frequently. You are responsible for verifying and complying with the current regulations published by the appropriate state wildlife agency before you fish.

Use at Your Own Risk

Fishing and outdoor activities involve inherent risks, including but not limited to injury, accidents, or environmental hazards. By using the Service, you acknowledge that you assume full responsibility for your actions and experiences on or near rivers or natural areas.

The Service is provided "as is" and "as available". We do not guarantee the accuracy, reliability, or completeness of river conditions, weather forecasts, access points, fly recommendations, or regulatory information.

9. Limitation of Liability

To the maximum extent permitted by law, River Caddy LLC and its members, officers, employees, or affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages — including injury, loss of data, loss of profits, or property damage — arising from your use of or inability to use the Service.

10. Indemnification

You agree to indemnify and hold harmless River Caddy LLC from any claims, damages, losses, or legal fees resulting from your violation of these Terms or your use of the Service, including injuries or accidents occurring during outdoor activities influenced by the Service.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, especially if you violate these Terms. If your access is terminated while a paid subscription is active, refunds (if any) are handled solely by Apple per Section 3.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service. Your continued use after changes indicates acceptance.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict of law principles.
